There are three steps for a foreign investor to reach the American Dream:

 

Invest in the United States of America

Invest a minimum of $900,00 into an approved USCIS EB-5 Project provided by American Immigration Group. American Immigration Group’s, EB-5 investment offerings are structured in such that each EB-5 investor should be able to meet the requirements of the EB-5 investor visa program. A primary requirement is the creation of 10 new jobs for qualified American workers.

 

Immigrate to the United States of America

Success in EB-5 ultimately provides US Permanent residency (US Green Card) to the EB-5 foreign investor, his/her spouse, and their unmarried children under 21 years old. The initial approval comes within 18-29 months and you are eligible to enter the US, together with your family.

 

Live in the United States of America

At maturity of your investment, the project has to repay the loan and the Regional Center will return your investment amount together with any accrued interest to all the investors. US Permanent Residents may live, work, and give their children access to the US schools and colleges.  5 years after entering the US with an EB-5 visa you are also eligible to become a US citizenship. 

 

EB-5 Immigration Process

There are a few steps in the EB-5 immigration process for an EB-5 investor to become a permanent resident or get the US Green Card. The process starts with the EB-5 project selection. The project should be provided by a USCIS-approved Regional Center. Once the EB-5 investor selects and invests in a project, he/she can then file an I-526 petition requesting a conditional Green card. The USCIS will ultimately determine whether the EB-5 investor qualifies for the EB-5 visa. Due diligence by USCIS during this part of the process includes a detailed review of the sources of the EB-5 investor’s funds, his/her background and family history. This petition also includes a description of the EB-5 investment, business plan and any economic models used to determine job creation. American Immigration Group’s Banyan Cay Hyatt Hotel and the Kingsbridge National Ice Center are both already approved by USCIS, so the investor does not have to worry about being denied because of the project. When approved, the EB-5 investor will need to schedule a meeting at their local US consulate or embassy and receive the EB-5 Visa. Upon entering the US on an EB-5 visa, the investor is considered a conditional permanent resident and receives their US Green Card shortly after. The conditional Green Card that the investor receives initially is valid for two years. 90 days before the end of the two-year conditional, the EB-5 investor and their attorney will file the I-829 petition to remove the conditions on the Green Card. This petition demonstrates that the EB-5 investor’s capital was fully invested and at risk during the two-year period and that the necessary 10 qualifying jobs have been created. The Regional Center will provide the proof of job creation at this stage. Upon approval of the I-829 petition, the EB-5 investor and his or her qualified family members become permanent residents and will ultimately choose to become US citizens.

 

EB-5 Timelines

Below is the timeline for an EB-5 Program Investment:

Once a confidentiality agreement is signed, the prospective EB-5 investor is sent the Private Placement Memorandum and all other related documentation.

EB-5 investor executes the subscription documents and returns them back to the Regional Center. The EB-5 investor then transfers their subscription fee to an escrow account established by the partnership on behalf of the investor where funds are held by the escrow bank. The release of funds from escrow can only occur according to the terms of the Escrow Agreement. American Immigration Group’s Administrative Placement Agent reviews the EB-5 investor’s subscription for suitability and compliance with securities laws. Once processed, the EB-5 investor is formally accepted as a limited partner in the partnership.

The investor’s immigration attorney files the I-526 petition with the USCIS, once the EB-5 investor is accepted as a limited partner into the EB-5 program.

Once the I-526 petition is approved, the EB-5 investor applies for a conditional Green Card through a US consulate interview in his/her country resident. If the I-526 petition is denied, the investor’s capital contribution would be returned to the limited partner in accordance with terms of the partnership agreement. Source of fund during this process is very important, to avoid the denial of the I-526 petition for the applicant. An experienced immigration attorney is highly recommended to follow the immigration process of the application.

Once the EB-5 investor is approved for a visa and a visa is available, the investor and qualified family members are issued conditional green cards that are valid for two years. The EB-5 investor must enter the US within 180 days for the day the visa is issued if they are not already in the US.

By the end of the EB-5 investor’s conditional Permanent Residency period, the investor’s immigration attorney files the I-829 petition to remove the conditions on the green card. Once the conditions are removed the EB-5 investor receives their permanent resident card valid for 10 years that can be renewed. 

Once all investments of the partnership are repaid, the limited partners can vote to liquidate the partnership and distribute the balance of each capital account according to the Partnership Agreement.
